You can now add BCBG to the long list of defendants involved in “knock-off” cases this year. First, Cartier sued Hautelook over watches, Burberry sued BodyGlove over check phone cases and now Givenchy is taking BCBG to court over the BCBGeneration Rembrandt handbag for “trade dress infringement,” (because it’s similar to the Givenchy Nightingale Bag, $2,175) and “unfair competition” (because BCBG’s version is actually affordable).
We got our hands on the court docs, and Givenchy even goes so far as to call the Rembrandt a “knock-off.” Givenchy explains that it is suing-mad because the original bag “has developed a secondary meaning and significance in the minds of purchasing public” – aka, it’s kind of a big deal – and cites it’s legitimacy because it was “featured in such high-profile magazines as Vogue“.
